Iris Wallet Terms of Use

1. Non-Custodial Service and User Control
1.1 Nature of Service
The Wallet is a non-custodial software application that allows you to generate a public/private
key pair (which can be thought of as a blockchain account and related password) to interact with
blockchain protocols. We do not operate a hosted wallet service. We never have access to,
custody, or control over your digital assets or private keys.
1.2 No Custody Disclaimer
WE DO NOT:
Have access to the security key that permits you to access your funds
Store, hold, or maintain custody of your private keys or secret recovery phrase
Have the ability to reverse, cancel, or recover blockchain transactions
Have the ability to restore access to your wallet if you lose your credentials
Operate as a financial institution, money services business, or custodian
1.3 User Sovereignty
You acknowledge and agree that:
You are solely responsible for the use and security of your security keys
We will not be held responsible if you share any keys or secret recovery phrases with anyone else, whether knowingly or unknowingly
You maintain complete and sole control over your digital assets
We are solely a software provider facilitating direct interaction with blockchain protocols
1.4 Third-Party Integrations and User Modifications
The Wallet may be integrated into, connected with, or modified for use with third-party systems, applications, or services. You acknowledge and agree that:
You are solely responsible for any modification, integration, or connection of the Wallet to any software, system, or method, whether developed by you or third parties
You are responsible for ensuring that any such integration or use complies with all applicable laws and regulations in your jurisdiction
We disclaim all responsibility and liability for uses, integrations, or implementations that are chosen, designed, or implemented by you or at your direction
Any third-party system utilizing our Wallet remains subject to these Terms, and you are responsible for ensuring that any end users of such integrated systems understand and comply with these Terms
We do not review, endorse, or support any third-party integrations, and such integrations are undertaken entirely at your own risk
2. Critical Security Responsibilities
2.1 Secret Recovery Phrase
You are solely responsible for properly configuring and using the Wallet and otherwise taking
appropriate action to secure, protect, and backup your accounts in a manner that will provide
appropriate security and protection.
Your obligations include:
Recording and securely maintaining any passwords or secret recovery phrases that relate to your use of the Wallet
Understanding that certain methods of securing your secret recovery phrase, such as storing it as a digital file anywhere, including on your personal device or on a cloud storage provider, increase the risk that your account or secret recovery phrase will be compromised
Never sharing with us nor any other third party any password or secret recovery phrase
Understanding that we take no responsibility whatsoever for any theft of a secret recovery phrase that involved intrusion through any means into your personal device or cloud provider's data repository
2.2 Irrecoverable Nature
YOUR SECRET RECOVERY PHRASE MUST BE KEPT SECRET AT ALL TIMES. WE WILL
NOT STORE A BACKUP OF, NOR WILL BE ABLE TO DISCOVER OR RECOVER, YOUR
PRIVATE KEY OR SECRET RECOVERY PHRASE.
3. Blockchain Risks and Transaction Finality
3.1 Inherent Blockchain Risks
OUR WALLET RELIES ON EMERGING TECHNOLOGIES, SUCH AS NOCKCHAIN AND
OTHER BLOCKCHAIN PROTOCOLS. BY USING THE WALLET YOU EXPLICITLY
ACKNOWLEDGE AND ACCEPT THESE HEIGHTENED RISKS:
You are financially and technically sophisticated enough to understand the inherent risks associated with using cryptographic and blockchain-based systems
Blockchain-based transactions are irreversible
Your private key and secret recovery phrase must be kept secret at all times
Digitally copying and storing your secret recovery phrase on a cloud storage system or other third party supported data storage, including your personal device, may increase the risk of loss or theft
You understand that we do not operate any blockchain protocol, communicate or execute protocol upgrades, or approve or process blockchain transactions on behalf of you
3.2 Transaction Responsibility
You are solely responsible for any approvals or permissions you provide by cryptographically
signing blockchain messages or transactions, especially those responding to solicitations and
other prompts from third parties.
4. Third-Party Content and Services
4.1 Third-Party Integrations
Third Party Content and Third Party Services are provided for your convenience only. We do not verify, curate, or control Third Party Content. We do not control Third Party Services.
As a result:
We do not guarantee, endorse, or recommend such content or services to any or all users
You access, rely upon or use any Third Party Content or Third Party Service at your own risk
We disclaim all responsibility and liability for any losses on account of your reliance upon or use of such content or services
We reserve the right to change, suspend, remove, disable, or impose access restrictions or limits on the use of any Third Party Service at any time without notice
4.2 DeFi and Smart Contract Interactions
WE DO NOT CONTROL ANY THIRD-PARTY SERVICE, APPLICATION, OR PROTOCOL
THAT YOU INTERACT WITH THROUGH THE WALLET.
When using wallet connections (including "Sign-in with Iris Connect"):
You alone are responsible for all interactions with third-party services accessed through wallet connections
Connection requests and signatures are binding authorizations that may grant access to your wallet information or transaction capabilities
We do not verify, monitor, or audit the legitimacy, safety, or practices of any third party requesting wallet connections
Social engineering attacks through fake connection requests are a risk - you are solely responsible for evaluating legitimacy
The wallet connection feature is a technical interface only. We make no representations about third-party services' security, data handling, or compliance with laws.
5. Swap and Trading Features
5.1 Nature of Swaps
When swap features are available:
Swaps are facilitated through third-party decentralized exchanges
You may view, have access to, and use the informational content, products, or services of one or more third parties
Your use of such services will be subject to separate terms and conditions set forth by the applicable third party service provider
It is your responsibility to understand the terms and conditions of Third Party Services
5.2 Swap Disclaimers
We do not:
Guarantee exchange rates or prices shown in the interface
Control slippage, failed transactions, or network fees
Verify the legitimacy of tokens available for swapping
Provide investment advice or recommendations
6. Prohibited Activities
6.1 Sanctions and Compliance
You represent that you are:
Not subject to sanctions or otherwise designated on any list of prohibited or restricted parties, including but not limited to the lists maintained by the United Nations Security Council, the U.S. Government (i.e., the Specially Designated Nationals List and Foreign Sanctions Evaders List of the U.S. Department of Treasury and the Entity List of the U.S. Department of Commerce), the European Union or its Member States, the United Kingdom, or other applicable government authority
Not located in any country subject to a comprehensive sanctions program implemented by the United States
Not prohibited from receiving software or technology under U.S. export control laws
6.2 Acceptable Use Restrictions
You agree not to, and not to allow third parties to, use the Wallet:
To violate, or encourage the violation of, the legal rights of others
For any unlawful, invasive, infringing, defamatory or fraudulent purpose
To intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature
To interfere with or circumvent any aspect of the Wallet
To use scraping techniques to mine or otherwise scrape data
To resell or sublicense the Wallet unless otherwise agreed in writing
To circumvent geographic restrictions or sanctions screening
To violate export control laws or regulations
To use the Wallet if you are under 18 years of age
7. Disclaimers and Limitation of Liability
7.1 Service Disclaimer
THE WALLET IS PROVIDED "AS IS. " EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE:
(A) MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE REGARDING THE WALLET, THIRD PARTY CONTENT, OR THIRD PARTY SERVICES
(B) DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED OR EXPRESS WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUIET ENJOYMENT
7.2 Limitation of Liability
WE SHALL HAVE NO LIABILITY FOR:
Lost profits, revenues, goodwill, or indirect, special, incidental, consequential damages
Loss of your private keys or recovery phrases
Assets sent to incorrect addresses
Assets lost to scams, phishing, or social engineering
Losses from smart contract failures or exploits
Device compromise or malware infection
IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
8. Data and Privacy
8.1 Local Storage
Private keys are generated and stored locally on your device
We do not have access to locally stored wallet data
Transaction history is derived from public blockchain data
You are responsible for device-level security
8.2 Network Privacy
You understand that:
Blockchain transactions are publicly visible and permanent
RPC providers may log your IP address and transaction requests
We cannot delete or hide blockchain transaction history
9. Support and Security Warnings
9.1 Support Limitations
You are aware that our customer support efforts may be impersonated by malicious third parties, and you agree that we are not responsible for the actions of such impersonators.
We will never:
Ask you for your private key or secret recovery phrase
Ask you to make a payment to us
Offer support via SMS, WhatsApp, Telegram, WeChat, or Twitter DMs
9.2 Phishing Awareness
WARNING: There are technical measures in the Wallet that improve user safety, and you are
solely responsible for understanding how they function and using them as appropriate.
10. Indemnification
You will defend, indemnify, and hold harmless us, our affiliates and licensors, and each of their respective employees, officers, directors, and representatives from and against any losses arising out of or relating to any claim concerning:
Breach of this Agreement or violation of applicable law by you
A dispute between you and any of your customers or users
Your loss of private keys or recovery phrases
Your interactions with third-party protocols or tokens
11. Fiat On-Ramp and Payment Services
11.1 Third-Party Payment Providers
The Wallet may integrate with third-party payment service providers ("Payment Providers") such as MoonPay, Transak, or similar services to purchase digital assets with traditional payment methods.
These are Third Party Services. We do not operate or control any Payment Provider. Your use is governed by the Payment Provider's separate terms, privacy policy, and payment agreements.
11.2 KYC and Data
When using fiat services:
Payment Providers require identity verification (KYC/AML)
You provide information directly to the Payment Provider, not to us
We do not control or access your KYC information
Your wallet address will be shared with the Payment Provider for delivery
Payment Providers may reject or limit your purchases based on their risk assessment
11.3 Disclaimers
WE ARE NOT LIABLE FOR:
Payment failures, delays, or exchange rates
Payment Provider fees or service availability
Chargebacks or disputed transactions
Loss of funds during payment or delivery
Payment Provider compliance with laws in your jurisdiction
The inclusion of any Payment Provider does not constitute our endorsement. Payment Provider services may not be available in all jurisdictions. You are responsible for ensuring your use complies with local laws.
12. General Legal Terms
12.1 Eligibility
You must be at least 18 years old to use the Wallet. By using the Wallet, you represent and warrant that you meet this requirement. The Wallet is not intended for children under 13 years of age.
12.2 License Grant
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Wallet solely for your personal, non-commercial use. We and our licensors retain all rights not expressly granted.
12.3 License Restrictions
You will not:
(a) Copy, modify, or create derivative works of the WalletPayment Provider fees or service availability
(b) Reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code
(c) Sell, resell, sublicense, or transfer the Wallet
(d) Use any automated means to access the Wallet
(e) Remove any proprietary notices
12.4 Intellectual Property
The Wallet, our trademarks, service marks, and logos are our property or our licensors' property.
No rights to use our marks are granted except as expressly set forth in these Terms.
12.5 Updates
We may update the Wallet periodically. You consent to automatic updates. You are responsible for installing updates to maintain security and compatibility.

WE ARE NOT LIABLE FOR:
Payment failures, delays, or exchange rates
Payment Provider fees or service availability
Chargebacks or disputed transactions
Loss of funds during payment or delivery
Payment Provider compliance with laws in your jurisdiction
The inclusion of any Payment Provider does not constitute our endorsement. Payment Provider services may not be available in all jurisdictions. You are responsible for ensuring your use complies with local laws.
13. Fees, Taxes, and Network Costs
13.1 Network Fees
All blockchain transactions require network fees (gas fees) paid to miners. We do not control or receive network fees. Fee estimates are not guarantees. Transactions may fail while still incurring fees.
13.2 Taxes
You are solely responsible for determining and paying any taxes applicable to your use of the Wallet and your blockchain transactions. We do not provide tax advice.
13.3 Service Fees
If we charge any fees for optional services, they will be clearly disclosed in the interface and may change with reasonable notice.
14. Regulatory Compliance
14.1 No Financial Advice
THE WALLET AND ANY INFORMATION PROVIDED ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE INVESTMENT, FINANCIAL, LEGAL, OR TAX ADVICE. YOU ARE SOLELY RESPONSIBLE FOR YOUR DECISIONS.
14.2 Regulatory Status
We are not a bank, broker-dealer, investment advisor, money services business, money transmitter, exchange, or custodian. We are a software provider only.
14.3 Export Control
You represent that you are not prohibited from using the Wallet under U.S. export control laws. You will not use the Wallet for any prohibited end use under applicable export laws, including nuclear, chemical, biological weapons, or missile technology.
14.4 RPC and Infrastructure
The Wallet connects to blockchain networks via RPC endpoints that may be operated by us or third parties. These providers may log your IP address and transaction requests.
15. Changes, Termination, and Disputes
15.1 Changes to Terms
We may modify these Terms at any time by posting revised terms with an updated "Last Modified" date. Your continued use after changes constitutes acceptance. Material changes will include reasonable notice where feasible.
15.2 Termination
We may suspend or terminate your access for any reason, including violation of these Terms.
You may stop using the Wallet at any time. Sections that by their nature should survive termination will survive.
15.3 Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
15.4 Arbitration and Class Action Waiver
ANY DISPUTE ARISING FROM THESE TERMS OR YOUR USE OF THE WALLET WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION IN ACCORDANCE WITH THE AMERICAN ARBITRATION ASSOCIATION'S CONSUMER ARBITRATION RULES. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
The arbitration will be conducted in Texas. To opt out, email legal@nockbox.org within 30 days
of first use with subject line "ARBITRATION OPT-OUT."
15.5 Contact Information
16. General Provisions
16.1 Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Wallet and supersede all prior agreements.
16.2 Severability
If any provision is held unenforceable, the remaining provisions will continue in effect.
16.3 No Waiver
Our failure to enforce any provision is not a waiver of that provision.
16.4 Assignment
You may not assign these Terms without our written consent. We may assign these Terms freely.
16.5 Electronic Communications
You consent to receive electronic communications from us. Electronic communications satisfy legal requirements for written communications.
17. Platform-Specific Terms
17.1 Browser Extension
If using the Wallet as a browser extension, you acknowledge that browser security vulnerabilities or conflicts with other extensions may impact Wallet security. You are responsible for browser security and updates.
Acceptance
BY USING THE WALLET, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.
